Dassey's Lawyer Will Ask For Change Of Venue

MANITOWOC- Newspapers across Wisconsin have carried news today that Len Kachinsky, the attorney for 16-year-old Brendan Dassey,  will ask the court for a change of venue.

Dassey and his uncle, Steven Avery, are charged with sexual assault and first degree intentional homicide of Teresa Halbach last Halloween.

Attorney Len Kachinsky from Sisson and Kachinsky Law Offices* of Appleton says the case has received a lot of attention and he wants to be sure Dassey gets a fair trial.

Kachinsky says he plans to vigorously defend his client against charges he raped, murdered and helped burn Halbach's body.

Kachinsky says he will ask Judge Fox for a change of venue due to the amount of publicity the case has received. Kachinsky also said he will be reviewing Dassey's 4-hour videotaped alleged confession.

Dassey and Avery will be back in court for additional hearings in the near future

Dassey will plead not guilty to the crimes. Steven Avery has already pleaded not guilty.  " A change of venue is necessary for a fair trial in this case," Kachinsky explained.

Change of Venue Motion

A motion for change of venue is a request that is filed with the court asking that a jury be selected from another location than the county of the alleged crime. An impartial jury of one's peers is one of the basic rights afforded the citizens of America. Not every case with some pretrial publicity warrants a change of venue.  The seriousness of the offense, the nature of the pretrial publicity and the role of the State in generating the publicity are key factors in determining whether such a motion will be granted.  "We only file change of venue motions in the cases where they deserve serious consideration.  This enhances our professional credibility and benefits all of our clients," Kachinsky noted.
